Abstract

This chapter discusses the frequently asked questions and the related responsibilities of healthcare personnel, and emphasizes the utilization of uniform examination protocol in dealing with rape or sexual cases. Rape or sexual assault is a crime of violence against a person’s body and will. It can result in physical trauma, and significant mental anguish and suffering for victims. The recent legal changes after Nirbhaya incident have posed many questions in the minds of healthcare providers while dealing with the survivors/accused of sexual violence. Currently, with a lot of changes in the medical examination of sexual violence victims/survivors and accused, adequate dissemination of this information to all stakeholders of healthcare sector along with proper training is required. It is hoped that the healthcare sector would raise to the occasion in dealing with this problem by both being ethical and legal, and also being gender sensitive to the concerns of all sexual violence survivor and accused. This chapter also briefly discusses the latest guidelines and uniform protocol mandated by the Health Ministry that highlights the medical and forensic responsibilities of the medical practitioner.
