Abstract

This chapter presents discussion on examination of a sexual assault victim in question and answer format. Sexual violence and sexual act are different and the differences need to be understood. It is an offence to refuse treatment for sexual assault victims. Both public and private health care institutions should provide care to them. The procedures followed in the examination of a sexual assault victim are called standard operational procedures (SOP). Specimen collection is an important aspect of investigation. It aims at detecting spermatozoa, seminal stains, foreign body, hair, blood stains, tissues etc., which would help to prove the sexual violence, identify the culprit, etc. Section 370 IPC deals with human trafficking for exploitation will be punished with imprisonment ranging from at least 7 years to imprisonment. Section 376 A is an addition–under this there is a provision for rigorous imprisonment for not less than 20 years of the person committing a sexual offence if it results in death or permanent vegetative state of the person or to any person involved in gang rape. Every country has one or the other forms of definitions and legal procedures for sexual violence.
