Abstract

Naturally, disasters requiring a post mortem Caesarian section also involve a need for difficult and galactic ethic decisions. In spite of this, it appears that an incident such as the one presented—a father objecting to a Caesarian section for saving the life of his son who is in the body of his dead mother—is one of the stormiest and complex that has been debated in recent years. The article below therefore constitutes an attempt to describe this painful affair from its ethical–Jewish aspect. The Chief Rabbinate of Israel ruled that death of the brain stem is considered death. Halachah–Jewish Law grants a certain status to the fetus. According to the Halachah, if a fetus in the womb of a dead mother is considered alive it must be delivered.
