With this view alive, the author of the book Shri JVN Jaiswal, a former member of UP Higher Judicial Service has treated the subject objectively and methodically. Though only one aspect, medical negligence to the consumers has been dealt with whereby all the spheres of the medical science have been elaborated in relation to those negligences of the medical service rendered. The negligence in the field of medical science has been dealt with objectively and with clarity and that symbolizes the stupendous exercise, to which the author has analytically resorted to.

I think, the expertise, with which the author has commendably assumed the task elucidating abstruse points, which appeared to be enigma to the consumers, deserves appreciation.

I am confident that this book would be much helpful to the consumers, lawyers and doctors alike and the treatise would serve everyone with remedial grievances.

As a matter of fact, the cases against the doctors are increasing everyday regarding their alleged negligence and deficiency in service. Previously such cases were dealt under the general law (Law of Tort and Contract Act), but with the enactment of Consumer Protection Act the medical services have been included in the ‘service’ as defined under the Act with the result such cases have arisen in a good number. One main reason for this increase is that no court fee has to be paid on such cases and comparatively the decision takes less time. Some unscrupulous litigants also try to file false cases either because the law on the subject is not understood by them in its true perspective and also because there is a feeling that ‘file a case and collect the fruits’ as the compensation has to be awarded against doctors. However, the Legislature was aware of this possible misuse and, therefore, provisions have been made to curb such practice. A chapter has been devoted on such false litigation.

The law on the subject is vast and it is not possible to foresee all the eventualities. However, a humble attempt has been made to provide as much matter on the subject as possible keeping in view the decisions of the various redressal agencies created under the Act and the decisions of various High Courts and the Supreme Court. The Consumer Protection Act has also been amended in the year 2002.

The author is, however, highly grateful to Justice AN Dikshita, retired High Court Judge, who took all the pains to go through the manuscript and make valuable suggestions and write a Foreword for this book. The author is also grateful to all those persons who have helped him and gave valuable suggestions to make this venture a success.

In fact, the author shall be grateful to receive valuable suggestions from the esteemed readers that may make the book more useful.
